Terms for Submitting Content

GM is allowing you to submit video and textual content as part of this Web Site (“User Submissions”). By submitting User Submissions to GM, you grant GM a worldwide, non-exclusive, royalty-free, sub-licenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display and perform the User Submission in all forms and media throughout the world for any and all purposes as General Motors Corporation shall desire.

All contributions will be screened to ensure they meet the Rules of the Road. These include:

  • Information should be truthful and verifiable. You are encouraged to cite sources (or link to online sources) when applicable.
  • Always be respectful of competitors and adversaries, no matter what the situation.
  • Content must be free of profanity, disparaging comments, personal attacks, depiction of unlawful behavior, commercial or political messages, racism, slander and libel.
  • Posted content must be on-topic (relevant to the subject you are contributing).
  • Content must not infringe on any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party.
  • All Privacy Rights must be observed.

Note: Submitted content (or changes to existing content) will not be posted if the "Rules of the Road" are not followed. Should any content be rejected, the submitter will be notified via email.

YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT AND POWER TO GRANT GM THE RIGHT TO USE THE USER SUBMISSION AS PROVIDED FOR IN THESE TERMS FOR SUBMITTING CONTENT. FOR AVOIDANCE OF DOUBT, YOU REPRESENT AND WARRANT THAT, TO THE EXTENT GM’S USE OF YOUR USER SUBMISSION AS AUTHORIZED HEREUNDER, WOULD OTHERWISE INFRINGE THEPATENT, TRADEMARK, TRADE SECRET, COPYRIGHT OR OTHER PROPRIETARY RIGHT (SUCH AS PRIVACY AND PUBLICITY RIGHTS) OF ANY THIRD PARTY, YOU HAVE ECURED THE APPROPRIATE LICENSES, RIGHTS, CONSENTS AND PERMISSIONS FROM SUCH THIRD PARTIES TO ALLOW GM TO USE THE USER UBMISSION AS AUTHORIZED BY YOU HEREUNDER.

GM is not obligated to post a User Submission and, in the event GM does post a User Submission, GM may remove such posting at any time in its sole discretion, without notice, and has no obligation to repost a User Submission.

If GM receives a Copyright Infringement Notification that your work allegedly infringes the copyrights of a third party, we will remove the User Submission from our Web Site and advise you accordingly. You will be given an opportunity to submit a Counter Notice. If you are determined to be a repeat infringer, you will be prohibited from submitting any further User Submissions.

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into these Terms For Submitting Content, to abide by and comply with them, and make them binding upon your heirs, assignees, next of kin and personal representatives.

You agree to indemnify and hold harmless GM, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the GMnext Web Site; (ii) your violation of any term of these Terms For Submitting Content; (iii) you violation of any third party right including, without limitation, any copyright, property or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms For Submitting Content.

You explicitly consent and agree to the collection, processing, disclosure and use of your personal information in accordance with the Privacy Notice.

You confirm that anyone appearing in your submission is over the age of 18 or that you have obtained written consent from such person’s parent or legal guardian.

You agree that GM does not have any duty or liability, directly or indirectly, vicariously, contributory, or otherwise arising out of or related to your submission.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms shall be governed by, and construed in accordance with, the laws of State of Michigan, United States, without giving effect to any choice of law or conflict of law rules. All disputes arising out of or relating in any way to this Agreement shall be litigated only in courts residing in Macomb County, Michigan.

Privacy Notice

I understand that the information I provide, including but not limited to, my name, video clips including image and sound recording, and employment location (hereafter “Personal Information”, will be made available to General Motors Corporation (“GM”) . It may be shared with GM’s various business entities located around the world (hereafter “GM Entities”) in connection with the GMnext and for GM general marketing purposes only, unless required or permitted by applicable law or unless my consent is secured in advance.

GM has informed me that:

  • my Personal Information may also be disclosed to suppliers of GM Entities, but solely for the purpose of providing services in connection with GMnext and GM’s general marketing purposes. I am aware that GM Entities and their suppliers are domiciled in various countries, many of which do not have the same data protection laws as those of my country.
  • any video clip may be posted by GM on its Web Site or on other websites hosted by third parties for public viewing in connection with the GMnext and GM general marketing purposes
  • GM Entities will exercise due care with respect to the security of my Personal Information;
  • I may access my Personal Information used or maintained by or for GM, including on GM websites in accordance with applicable law and established procedures for the purposes of updating, correcting, or deleting it by contacting the appropriate entity below
  • should I have any questions or wish to withdraw or limit my consent to use the personal information that I have provided, that is used or maintained by or for GM, including on GM websites, I may contact the appropriate entity below

Copyright Infringement Notification

To file a copyright infringement notification with us, you will need to send a written communication that contains the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material on our Web Site that is claimed to be infringing, with information reasonably sufficient to allow us to locate the material.
  4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number and, if available, an electronic mail address at which the complaining party may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material in the matter complained of is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter Notice

If you believe that your User Submission which was removed from our Web Site in response to a Copyright Infringement Notification is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to law, to post and use the content in your User Submission, you may send a counter-notice to GM containing the following information:

  1. Your physical or electronic signature.
  2. Identification of your User Submission which was removed.
  3. A statement that you have a good faith belief that the content was removed as a result of a mistake or misidentification of the content.
  4. Your name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal court in Detroit and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

If a Counter-Notice is received by GM, GM may send a copy to the original complaining party, informing them that the objected to User Submission may be reposted in 10 business days. Unless the copyright owner files an action seeking a court order against you to restraint your allegedly infringing activity, your User Submission may be reposted at GM’s sole discretion.
